Learned advocate appearing for the petitioner submits that the subject matter of the case relates to recovery of 15 bottles of Phensedyl allegedly from the possession of the petitioner and the petitioner is in custody for more than 4 months. It has been contended that charge sheet has already been submitted, as such further detention is unwarranted.
Learned advocate for the State opposes the prayer for bail.
I have taken into account the period of detention, stage of the case and I am of the view further detention of the petitioner is unwarranted in the present case.

Accordingly, the prayer for bail of the petitioner is allowed. Petitioners, namely, (1) Mithu Mandal @ Mithun Mandal, & (2) Bhola Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Court (under NDPS Act) cum Learned Additional Sessions Judge, 3rd Court, Malda.
If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Malda without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) 1734 of 2025 is allowed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
