JUDGMENT:
The present appeal is filed aggrieved by the orders passed in F.C.O.P.No.153/2008, dated 28.11.2008 granting maintenance of Rs.3,000/- per month to the petitioner/respondent herein from the date of the petition.
2. Considering the submissions and on perusal of the record, this Hon’ble Court granted interim order on 27.01.2009 which reads as follows:
“There shall be interim suspension of the judgment subject to the condition, appellant depositing Rs.2,000/- (Rupees two thousand). On such deposit, the respondent is at liberty to withdraw the same without furnishing any security, commencing from February, 2009, every month on or before 07th of every month”

Learned counsel for the appellant submitted that the appellant is continuously paying the maintenance in terms of interim order granted by this Court. As far as arrears are concerned, he requested short time to get instructions.
4. Considering the submissions and on perusal of the material placed on record, it is clear that the appellant is continuously paying the maintenance in terms of interim order granted by this Court. There is no response from the respondent and as far as arrears of maintenance is concerned from 11.01.2008 to 28.11.2008 nearly it comes to Rs.20,000/-. Hence, the appeal is disposed of confirming the interim orders dated 27.01.2009 and the

appellant is directed to pay the arrears amount in three months and in three instalments.
5. With the above directions, the Family Court Appeal is disposed of. Consequently, miscellaneous petitions, if any, pending in this appeal shall stand closed.
