JUSTICE TARA VITASTA GANJU ORAL ORDER (PER: HON'BLE MR. JUSTICE JAYANT BANERJI) The contempt petition is filed on 12.02.2025 alleging deliberate disobedience of the order dated 13.09.2024 passed in W.P.No.38419/2016. The operative part of the order of the writ Court reads as follows: "11. The respondents are directed to settle the terminal benefits within three months from the date of this order. The petitioners are directed to vacate the quarters within three months from the date of settlement of their terminal benefits. 12. On 02.03.2026, a compliance affidavit was filed, which is sworn to by J.K.Prasad, working as General Manager of M/s.HMT Machine Tools Limited. It is stated therein that the petitioner has neither produced the required no dues certificate from the Anxillary Business Division (ABD) of HMT Ltd. nor did he come forward to collect the cheque as communicated by the Company. It is stated that the Company had duly complied with the directions issued by this Court in W.P.No.38419/2016 by issuing a detailed reply dated 13.12.2024 informing the petitioner about the adjustment of eligible terminal benefits and the procedure for collection of the benefits cheques. It is stated that without completing the necessary formalities, the petitioner has chosen to initiate the present contempt proceedings. Copies of the letters dated 17.07.2025, issued to the complainant and the other issued to the Manager of UCO Bank, Jalahalli, are enclosed with this affidavit. 3. A memo has been filed today in Court enclosing therewith the account statement of the Company concerned maintained at UCO Bank, Jalahalli Branch, Bangalore. Five entries of withdrawal are reflected in the bank statement - 4 - HC-KAR CNR: KAHC010101312025 NC: 2026:KHC:49226-DB CCC No.187 of 2025 reflecting transfers of the amounts specified in the letter dated 17.07.2025 issued to the complainant. Evidently, the accused has complied with the order of the learned Single Judge. 4. This contempt petition is consigned. 5. It is open to the accused to take such steps as may be advised for non compliance of the order of the writ Court by the complainant or for their eviction.
