By the order impugned dated August 1, 2026, the learned Single Judge directed the matter to go out of list upon, inter alia, holding that the appellants were not interested to move the matter before His Lordship. 2. We are told that the matter was listed on a Saturday and the learned advocate who appeared for the appellants could not produce the affidavit of service. 3. We are of the view that, on account of inability of the learned advocate to produce the affidavit-of-service, the appellants should not suffer. Accordingly, we set aside the order with a request to the learned Single Judge to hear out the writ petition within a period of one month from the date of communication of this order, upon the same being listed before His Lordship. Liberty to mention. 4. Learned advocates who appear in the appeal have informed us that they are not engaged in the writ 2 petition. Under such circumstances, fresh service be effected upon all the respondents, including the learned Government Pleader within a week. 5. The affidavit-of-service indicating service upon the respondents including the State respondent will be filed before His Lordship. 6.
