1. The petitioner is an accused in the case registered for the offence punishable under Sections 395 and 412 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. As per the allegation, four persons riding on two motorcycles abused and assaulted the informant and also took away his motorcycle. It is further submitted that the petitioner was not at all involved in commission of the alleged offence. The said motorcycle was allegedly recovered from a vacant house on the basis of the alleged confessional statement of the co-accused, Pradeep Kumar. The petitioner has not been put to Test Identification Parade. Though the petitioner has criminal antecedent, however, so far as the present case is concerned, he has been implicated in the same without cogent evidence. The

petitioner, however, undertakes to co-operate in the ongoing trial. The petitioner is in judicial custody since 17th January, 2023. Hence, he may be given the privilege of regular bail.
3. Learned A.P.P. opposes the petitioner’s prayer for regular bail.

Having heard learned counsel for the parties and considering the materials available on record, the petitioner is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Deoghar in connection with S.T. Case No.376 of 2023 arising out of Sarwan P.S. Case No.84 of 2022.
