The petitioner has been in custody for 296 days, and a charge-sheet has already been filed against him. It appears that the petitioner has passed the Madhyamik Examination as well as the Higher Secondary Examination in India.
The learned Advocate appearing for the petitioner submits that the petitioner’s Aadhaar Card and Voter Identity Card have been sent to the competent authority for verification.
In view of the aforesaid, this Court is of the opinion that further custodial detention of the petitioner is not necessary, particularly as there is no likelihood of the trial being concluded in the near future. At present, the matter
2 has only been fixed for the framing of charges against the petitioner.
Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of the like amount each, one of whom must be local, to the satisfaction of the learned Additional District and Sessions Judge, Fast Track Court – 1, Bongaon, North 24-Parganas.
It is further directed that the petitioner shall appear before the learned trial Court on every date of hearing until further orders and shall not intimidate any witnesses or tamper with evidence in any manner. Failure on the part of the petitioner to comply with the aforesaid conditions shall entitle the learned trial Court to cancel the bail granted to the petitioner in accordance with law, without any further reference to this Court.
Accordingly, CRM(M)/669/2026 stands allowed.
