The present writ petition has been filed, inter alia, praying for a direction upon the municipal authorities to demolish the unauthorized construction at premises No. 9K, Dum Dum Road Kolkata 700 030 . 3. Though the municipality is not represented, since Mr. Mukherjee, learned advocate who usually appears for the municipality is present in Court today, he is directed to represent the municipality with a junior of his choice. Let his appointment with a junior of his choice be regularized. 4. Having heard the learned advocates appearing for the respective parties and noting that a complaint has been made by the petitioner on 19th April, 2024 regarding unauthorized construction which is pending at the end of the municipal authorities, WPA 20920 of 2024 2 without going into the merits of the claim of the petitioner, I am of the view, it shall be prudent at this stage to direct Executive Engineer of the concerned Borough to dispose of the petitioner’s representation in accordance with law by passing a reasoned order and by carrying out an inspection at the locale upon giving an opportunity of hearing to the parties. 5. It is expected that the aforesaid decision shall be taken by the concerned executive engineer within a period of eight weeks from the date of communication of this order. It is made clear that if the order warrants proceeding for taking steps regarding illegal construction, such steps should be taken within a week therefrom. 6. With the above observations and directions, the writ petition is disposed of. (Raja Basu Chowdhury, J.)
