Mr. Arunanshu Chakraborty Mr. Arijit Bera ..for the petitioner This application under Article 227 of the Constitution of India is at the instance of a third party and is directed against an order rejecting the prayer for condonation of delay in preferring a title appeal challenging the judgement and decree passed in Title Suit No. 214 of 2011. The learned advocate appearing for the petitioner, in his usual fairness, submits that through inadvertence this application under Article 227 of the Constitution of India has been filed. He prays for leave to withdraw this civil revisional application with liberty to approach the appropriate forum in accordance with law. In the light of the submissions made by Mr. Chakraborty, learned advocate for the petitioner, C.O. 3170 of 2026 stands dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum in accordance with law. The learned advocate on record of the petitioner shall be permitted to take back the certified copy of the 2 order impugned by replacing the same with a photostat copy thereof.
