Rakib (Allowed) CRM (NDPS) 1703 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with English Bazar Police Station case no. 2534 of 2025 dated 18.12.2025 under Sections 21(C)/29 of the NDPS Act. And In the matter of : Rohit Kumar @ Rahit Kumar ……Petitioner. Mr. Arup Kumar Bhowmick ......for the Petitioner. Mr. Ooiseeroop Sinha Mr. Soumalya Dutta ……for the State. Learned advocate appearing for the petitioner submits that petitioner has been implicated on the basis of the statement of co- accused. There has been no recovery, although, the recovery in the present case is of 1.023 kg of brown sugar. Petitioner is in custody for more than eight months. Having considered that similarly placed another accused being Kanchan Prasad Yadav has been granted bail in CRM (NDPS) 840 of 2026 and the memo of evidence submitted by the State do not reflect that there are antecedents of the present petitioner or any other further recovery, I am inclined to release the petitioner on bail on same terms and conditions as was imposed upon Kanchan Prasad Yadav in CRM (NDPS) 840 of 2026. Accordingly, the prayer for bail of the petitioner namely, Rohit Kumar @ Rahit Kumar is allowed. Thus, CRM (NDPS) 1703 of 2026 is allowed. 2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
