The petitioner, above-named, who is in custody since 24.01.2023 in connection with Bodam (East Singhbhum) P.S. Case No. 7 of 2023 (S.T. Case No.269 of 2023) for the offence registered under Section 302 of the IPC has prayed for regular bail. As per the prosecution case, petitioner is named in the FIR and there is direct allegation against him is that on a trivial dispute, the deceased was done to death by him. It is submitted by the learned counsel on behalf of petitioner that there is no eye-witness to the incident, and the motive has also not come in this case to implicate him. He is in custody for more than 2 years. It is further submitted that there is no other material save and except the disclosure statement on the basis of which, the weapon of offence is said to have been recovered. Learned A.P.P. for the State opposed the prayer for bail. Considering the submission made on behalf of the petitioner that matter rests on the circumstantial evidence and motive has not come out clearly in the statement of witnesses to police, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
