Sharma, learned Additional Public Prosecutor for the State. By this application, the petitioner has prayed for bail in connection with NDPS Case No. 05/2026 registered under Section 21(b) of the NDPS Act Page No.# 2/3 corresponding to Silchar P.S. Case No. 1118 of 2025. The FIR dated 08.11.2025 reveals that on an information received from reliable source about smuggling and dealing of suspected narcotic substance at Silchar Railway Station Road, the police personnel reached the place of occurrence and during the search operation, he saw one suspected female and detained her and on a body search being made five numbers of soap cases containing powdery substance suspected to be heroine was found from the possession of the said female. Ms. S Nawaz, learned Counsel for the petitioner submits that the petitioner is a lady of lower strata and that she has not been able to engage a counsel of her own and due to which a legal aid counsel was given to her. He further submits that police on completion of investigation has submitted charge sheet and a trial is on. He also submits that a petitioner has been inside for 125 days. The petitioner is found in possession of the contrabands which is of intermediate quantity. Mr. B. Sharma, learned Additional Public Prosecutor for the State, however, submits that the petitioner was found in possession of the said contrabands and charges already framed against her and a trial is on. On consideration of the submissions made by the parties and considering the length of detention of the petitioner, this Court finds it fit that the petitioner be released on bail on furnishing of a bail bond of Rs. 20,000/- with one local surety of like amount to the satisfaction of Special Judge, Cachar, Silchar under the following conditions: i) The petitioner will appear before the Trial Court as and when call for. ii) The petitioner will not influence the witnesses connected Page No.# 3/3 with the case.
