An application is filed for vacating stay. 3. Learned counsel for the petitioners is not present. 4. Learned counsel for the respondent No.2 submits that the petition is filed suppressing the fact that FIR is registered pursuant to the order passed by the Court in W.P.No.28534/2025. 5. The Court has perused the order dated 10.02.2026 in the said writ petition. The Co-ordinate Bench of this Court has directed the Additional Government Advocate to secure instructions as submission is made in the said petition that despite the complaint being filed, no action has been taken by the jurisdictional police. The Additional Government Advocate then made a submission that FIR is registered in Crime No.51/2026 and the same will be investigated. Learned counsel for the respondent No.2 also submits that, the fact that the aforesaid writ petition is filed, is brought to the notice of the petitioners when they applied for anticipatory bail and this fact was mentioned in the statement of objection filed by the respondent No.2 in the said bail proceedings. 7. The Court has perused the contents of the complaint. 8. The complainant has alleged that there is an attempt to dispossess the complainant from the immovable property. The complainant has asserted that the property belonged to complainant’s grandfather. After the demise of the grandfather and his father, complainant has undivided share in the property and has not sold any portion of the property to the petitioners. 9. The Court is of the view that the matter requires investigation and therefore, the proceedings cannot be quashed and the investigation cannot be stalled.
