Accused Nos.4 and 6/appellant Nos.1 and 2 have preferred this appeal against the order dated 12.12.2025 passed in Spl.C.No.331/2025 by the II Addl. District and Sessions Judge, Bengaluru Rural District, Bengaluru (for short, 'the Trial Court'). - 3 - HC-KAR CNR: KAHC010016662026 NC: 2026:KHC:50419 CRL.A No. 32 of 2026 2. On the basis of the complaint filed by one Manjunatha S/o Krishnappa, Sarjapura police have registered the case against the unknown accused for the commission of offence under Sections 103(1), 189(2), 191(2), 191(3), 61(2)(a), 238(b), 55, 190 of the Bharatiya Nyaya Sanhita (BNS), 2023 and Section 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Ordinance, 2014. During the course of investigation, accused No.4 was arrested on 07.02.2025 and was produced before the Magistrate. They were remanded to judicial custody. Till today, the accused are in judicial custody. After a thorough investigation, the Investigating Officer has submitted charge sheet against the accused Nos.1 to 11 and 1 Child with Conflict of law, for the commission of offence under 103(1), 189(2), 191(2), 191(3), 61(2)(a), 238(b), 55, 190 of the Bharatiya Nyaya Sanhita (BNS), 2023 and Section 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Ordinance, 2014. - 4 - HC-KAR CNR: KAHC010016662026 NC: 2026:KHC:50419 CRL.A No. 32 of 2026 Bail application was filed on behalf of present appellants. Same came to be rejected by the Trial Court on 12.12.2025. Being aggrieved by the rejection of bail application, the appellants have preferred this appeal. 3. The learned counsel for the appellants would submit that, the appellants are innocent. They have not committed any offence as alleged against them. The complainant has not at all mentioned the specific identity of the culprits to ensure that the persons who are arrested are the present accused/appellants who have allegedly committed the offence. The respondent police, instead of securing the real culprits, have arrested the present appellants at the instance of complainant who was having vengeance against them. As per records, there are no eye- witness to the same that the accused have involved or committed the alleged offence. Hence, there is no active participation of the accused in the alleged crime. Even though the accused are not at all involved in the - 5 - HC-KAR CNR: KAHC010016662026 NC: 2026:KHC:50419 CRL.A No. 32 of 2026 commission of alleged offence, the police have arrested them, only on assumption and in the guise that the accused are all friends and might have involved in the commission of alleged offence. But the present accused are no way related to the commission of alleged offence. The deceased was doing real estate business and having some dispute with some realtors, due to which he might have been killed by them. But the accused herein are absolutely strangers. Hence, there is no ill-will or motive to commit or involve in the commission of alleged offence. But their names have been falsely implicated only on assumption. Further he would submit that, CW1 alleged to have received a phone call from his friend Mr. Patil who, in turn, informed that the deceased got assaulted in front of Manjunatha Bakery, but at the same time, the wife of injured stated that on the date of incident, at about 09.15 pm, the deceased went out of the house and immediately she alleged to have been heard screaming of the deceased and when she rushed to the spot near the house, she - 6 - HC-KAR CNR: KAHC010016662026 NC: 2026:KHC:50419 CRL.A No. 32 of 2026 found her husband was lying on road with bloodshed and found 7 to 8 persons were moving away in their car and 3 bikes. There is contradictory version between evidence of the complainant and the wife of the deceased. But none of them have been in the scene of occurrence to say who had assaulted and killed the deceased. Further, he would submit that the accused were not at all aware of the alleged commission of offence. The IO has not recovered any weapon at the instance of accused No.4. The IO has not conducted Test Identification Parade (TIP). The alleged incident took place during night time. However, IO has not conducted TIP. Further, he would submit that, the FIR is registered against unknown accused. After lapse of 10 days, the accused Nos.4 and 6 were arrested. PWs.7 to 9, the alleged eye-witnesses, have not identified the accused. They have stated that only they came to know about the name of the accused and the accused are not at all required for further investigation. As against this, the learned High Court Government Pleader Sri Nageshwarappa.K would submit that the Trial Court has properly appreciated the materials on record and has come to the conclusion that the accused are not entitled for bail. Absolutely, there are no grounds to allow this appeal and sought for dismissal of the appeal. 5. I have examined the materials placed before this Court. On the basis of the complaint filed by Manjunatha S/o Krishnappa, Sarjapura police have registered the case against the unknown accused for the commission of offence under Sections 103(1), 189(2), 191(2), 191(3), 61(2)(a), 238(b), 55, 190 of the Bharatiya Nyaya Sanhita (BNS), 2023 and Section 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Ordinance, 2014. On careful examination of the materials placed before this Court, at this stage, it is crystal-clear that CW7- Ravichandra, CW8-Ganesha and CW9-Ranjitha, are the eye-witness to this incident. IO has seized the vehicles car and bike used for the commission of offence and also seized the weapons used to commit the commission of alleged offence, on the basis of the voluntary statement of the accused. Along with charge-sheet, the IO has also produced documents in proof of transfer of amount which is consideration amount for the commission of the crime. The Trial Court has opined that the accused Nos.4 and 6 were present at the scene of offence and have actively participated in the crime by assaulting the deceased. On re-appreciation of the entire material on record, I do not find any legal or factual error committed by the Trial Court. Accordingly, there are no sufficient grounds to grant bail.
