"The undersigned counsel for the appellant submits that in view of the judgment passed in CELESTIUM FINANCIAL v. A GNANASEKARAN ETC. [ 2025 SCC ONLINE SC 1320], the appellant is also entitled to file an appeal against the judgment of acquittal before the Sessions Court. Wherefore, it is prayed that this Hon'ble Court may be pleased to transfer the present appeal to the concerned appellate Court of Sessions & be considered as an appeal under proviso to Section 4B of BNSS, 2023 [Section 372 of Cr.P.C.]."

3. In view of memo and keeping in mind the
judgment of the Hon'ble Supreme Court, this appeal is

transferred to concerned District Court for disposal. Accordingly, the appeal is disposed of.
