The petitioner herein being aggrieved with the inordinate delay caused in disposal of interim monetary relief prayer made by her in a proceeding under Section 12 of the Protection of Women from Domestic Violence Act, 2005 being AC Case No.1712 of 2023 presently pending before learned 1st Judicial Magistrate, Alipore has preferred the instant application. Being aggrieved by the inordinate delay in disposal of her application for interim monetary relief, she submits that the said application was filed along with the main application on
23.06.2023. Petitioner has filed her affidavit of assets and liabilities but the opposite party/husband has not yet filed affidavit of assets and liabilities and he is taking time through different alibi one after another, and, therefore, she prayed for appropriate direction upon the Court below for expeditious disposal of the said interim monetary relief prayer. Having heard learned Counsel for the petitioner, it appears that the instant prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party
2 will have no cause to prejudice and as such service of copy of application upon the opposite party is dispensed with. Having considered submissions made on behalf of the petitioner that her prayer for interim monetary relief is pending for more than 3 years, I find that the prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice. In view of above, CRR 3818 of 2026 is hereby disposed of with a direction upon the Court below to dispose of petitioner’s application for interim monetary relief, preferably within a period of sixty days from the next date of hearing. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
