1. In this application, the petitioner has assailed the order dated 06.06.2026 passed by the learned Chief Judicial Magistrate, Howrah in connection with G. R. Case No.1947 of 2024. 2. Being aggrieved by the aforesaid order, learned counsel for the petitioner submits that the petitioner was initially enlarged on interim bail vide order dated 02.05.2024, however, by the impugned order the learned Court below cancelled the earlier bail order and issued warrant of arrest against the petitioner without giving the surety an opportunity to produce the petitioner before the Court. He further submits that since 02.05.2024, the petitioner never absconded from the process of law. Page 2 of 3

However, learned counsel appearing for the petitioner submits that the petitioner is ready and willing to face the trial and in such circumstances, a liberty may be given to him to surrender before the Court below. 4. Mr. Subir Ganguly, an empanelled lawyer of the State is appointed in this case to represent the State. A copy of this revisional application has been served upon him by the learned counsel for the petitioner. Department is directed to regularize the appointment of Mr. Ganguly in this case. 5. Mr. Ganguly appearing on behalf of the State submits that since the prayer made by the petitioner is innocuous, liberty may be given to him to surrender before the Court below. 6. Having heard the learned counsel for the petitioner and the State, the instant revisional application being CRR 2916 of 2026 is hereby disposed of with liberty to the petitioner to surrender before the Court below within a period of 14 days from this date and in the event of such surrender by the petitioner, the Court below will dispose of his prayer in accordance with law. 7.
The impugned order dated 06.06.2026 by which the Court below has issued the warrant of arrest against the petitioner shall remain stayed for a period of two weeks from date. 8.
