1. This bail application has been filed on behalf of the petitioners under Section 483 of B.N.S.S. in connection with FIR No. 396/2009 registered at Police Station Baadi, District Dholpur for offences under Sections 379, 120-B IPC and Section 29/51 of Wildlife (Protection) Act.

Learned counsel for the petitioners submits that the present matter pertains to bail jump. After getting benefit of bail, the petitioners went out of State for earning livelihood, therefore, they could not appear before the learned Trial Court and as such, their bail bonds were forfeited. Learned counsel further submits that the petitioners are senior citizens and they are in custody since
04.02.2026. Learned counsel undertakes that the petitioners shall
(2 of 3) [CRLMB-2870/2026] appear before the learned Trial Court on each and every date as fixed by the Court and that the petitioners shall not make any attempt to jump the bail again, therefore, in the interest of justice, the bail application of the petitioners may be allowed. 3. Per contra, learned Public Prosecutor vehemently opposes the bail application and submits that this is the second time when petitioners have jumped the bail. 4. Taking into consideration the overall facts and circumstances of the case; the arguments advanced by learned counsel for the petitioners, as also the undertaking of the learned counsel on behalf of the petitioners that henceforth the petitioners shall appear on each and every date as fixed by the learned Trial Court, but without expressing any opinion on merits / demerits of the case, this Court deems it just and proper to enlarge the petitioners on bail. 5. Therefore, this bail application under Section 483 of BNSS is allowed and accused-petitioners Betal Singh S/o Lala Ram and Rameshwar @ Rame S/o Lala Ram are ordered to be released on bail provided each of them furnishes a personal bond in the sum of Rs. 50,000/- with two sureties of Rs. 25,000/- each, out of whom one surety should be a close relative of the petitioners, to the satisfaction of the Trial Court for his appearance before the court concerned on all the dates of hearing as and when called upon to do so. 6. However, it is made clear that the petitioners shall not involve in similar offence(s) during currency of bail granted by this
(3 of 3) [CRLMB-2870/2026] Court. The petitioners are further directed to mark their presence in the concerned police station in second week of every month, till trial is concluded. 7. Concerned SHO is directed to maintain a register recording the attendance of the petitioners, as directed above.
In case the petitioners fail to mark their presence in the concerned police station, as directed above, the concerned SHO is directed to immediately report the matter to the concerned Court in this regard. 8. If breach of any of these conditions is reported or come to the notice of the Court, the same shall alone be a reason for the Trial Court to cancel the bail granted to petitioners by this Court. 9. It is made clear that in case of further misuse of liberty of bail, subsequent prayer of bail on behalf of the petitioners shall not be considered. (SANDEEP TANEJA),J SKS/54
