After hearing the learned counsel for the petitioner and going through the contents of the complaint, the Court is of the view that the contents of the complaint prima facie attract the provisions of the Bharatiya Nyaya Sanhita, 2023 as well as the provisions of the Dowry Prohibition Act, 1961. 2. The Apex Court in the case of M/s Neeharika Infrastructure (P) Ltd. v. State of Maharashtra and others1 in paragraph No.33.15 has held as under: "33.15. When a prayer for quashing the FIR is made by the alleged accused and the court when it exercises the power under Section 482CrPC, only has to consider whether the allegations in the FIR disclose commission of a cognizable offence or not. Thus, the Court is not required to examine the merits of the allegations made in the complaint. The Court is only required to see whether the allegations in the complaint prima facie attract the penal provisions. 4. The Court is of the view that the contents of the complaint do attract the penal provisions. Accordingly, the matter requires investigation. Hence, the petition is dismissed.
