None appears on behalf of the State. The prayer for anticipatory bail of the petitioner was earlier rejected in A.B.A. No. 2853 of 2015 on 12.04.2016. Submission has been advanced by the learned counsel for the petitioner that after the earlier rejection of the prayer for anticipatory bail, charge sheet has been submitted by the ACB. It has further been submitted that the partnership firm has not been made an accused in the criminal case. Learned counsel also adds that though the petitioner was a partner in the said firm which had executed the works but admittedly the petitioner was not a signatory to the agreement nor any money was advanced to him. It appears that the submissions with respect to the merits of the case were earlier considered in A.B.A. No. 2853 of 2015 and the said application was rejected. It is an admitted fact that the Work Order was issued to the partnership firm of which the petitioner is a partner and, therefore, the petitioner -1- cannot be absolved of the criminal liability fastened upon him by virtue of the illegal acts of the partnership firm. In such circumstances, therefore, I am not inclined to re-consider the prayer for anticipatory bail of the petitioner which stands rejected once again. This application stands rejected.
