Act, 1985 And In the matter of : Prasenjit Biswas ……Petitioner. Mr. Joy Chakrabarty Mr. Kunal Ganguly Mr. Subhodip Maity …for the Petitioner Mr. Somnath Adhikary Ms. M. Sinha …for the State 1. Learned Advocate appearing for the petitioner submits that petitioner is in custody for two years and three months. There has been no recovery from the present petitioner, although the total quantum of recovery in the present case is 2160 bottles of cough syrup. 2. Learned Advocate appearing for the State opposes the prayer for bail and submits petitioner was sub- tenant/lessee in respect of the property from where seizure has been effective. 3. There are communications/CDR available. Records reflects that out of 8 witnesses cited by the prosecution 5 2 witnesses have already been examined. P.W. 5 is in progress. Accordingly, a last chance is granted to the State to complete rest of the witnesses by 31st December, 2026. 4. At this stage prayer for bail of the petitioner is rejected. Petitioner will renew his prayer for bail after the aforesaid time period is over. 5. Accordingly, C.R.M (NDPS) 1759 of 2026 is dismissed. 6. Memo of evidence be kept with the record. 7. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court. 8.
