G.P. for Revenue The Court made the following: 3 BSB, J W.P.No.16862 of 2026 ORDER: This writ petition under Article 226 of the Constitution of India is filed seeking the following relief: “..to issue a Writ of Mandamus or any other appropriate Writ, Order or Direction, declaring the action of respondent No.4 in issuing the impugned Survey Notice / Proceeding, dated 11.06.2026 pursuant to the F-Line application filed by the third parties over the petitioner’s property of an extent of Ac.2.38 cents in Survey No.267/2, situated at Tammadapalli Village, Mahanandi Mandal, Nandyal District, as illegal, arbitrary, without jurisdiction, and in direct violation of the judgment and decree passed in O.S.No.88 of 1994 as well as Articles 14 and 300-A of the Constitution of India and consequently direct the respondents not to entertain any such survey application till deciding the appeal by the Revenue Divisional Officer and to pass such other order or orders…” 2. The case of the petitioner, in brief, is as follows: a. The petitioner is the absolute owner, title holder and peaceful possessor of the property admeasuring Ac.2.38 cents in Survey No.267/2 situated at Tammadapalli Village, Mahanandi Mandal, Nandyal District. He filed a suit in O.S.No.88 of 1994 on the file of the Court of the Principal Junior Civil Judge, Nandyal, seeking declaration of title and permanent injunction against respondent No.4 and after full- fledged trial, the Civil Court passed a decree in favour of the petitioner. The judgment and decree attained finality. 4 BSB, J W.P.No.16862 of 2026 b. Despite a decree in favour of the petitioner, the respondent No.4, Tahsildar, Mahanandi Mandal, Nandyal District, issued certain proceedings ignoring the absolute declaration of title passed by competent civil Court. Aggrieved by the same, the petitioner preferred an appeal before the respondent No.3, Revenue Divisional Officer, Mahanandi Mandal, Nandyal District. During the pendency of the appeal, the respondent No.4 entertained an application and issued survey notice proposing to conduct a boundary demarcation survey on the subject property. Hence, this writ petition. 3. The learned Assistant Government Pleader for Revenue placed on record written instructions of the respondent No.4, Tahsildar, wherein it was stated to the following effect: “The survey is not being conducted at present as the writ petitioner objected to conduct survey. An appeal petition filed by the petitioner is pending before the Revenue Divisional Officer, Nandyal.” 4. Recording the above written submissions, this writ petition is closed. There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed. ___________________ B. S.
