Accused no.1 in Crime No.58/2026 registered by Whitefield Police Station, Bengaluru City, for the offences punishable under Section 69 read with 3(5) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.58/2026 was registered by Whitefield Police Station, Bengaluru City, for the aforesaid offences against the petitioner herein and another based on the first information dated 12.06.2026 received from the victim lady. Apprehending arrest in the said case, petitioner herein had filed Crl. Misc. No.6169/2026 before the jurisdictional Sessions Court, which was rejected on 08.07.2026. Learned Counsel for the petitioner submits that petitioner who had undertaken to marry the victim lady on the last date of hearing, was granted interim bail for a limited period. She submits that since the victim lady has put forward various conditions, petitioner is not ready and willing to marry her. She submits that petitioner is ready and willing to cooperate with the police for the purpose of investigation. Accordingly, she prays to allow the petition. 5. Per contra, learned HCGP and the learned Counsel for respondent no.2 submit that the victim lady has not put forward any condition as submitted by the petitioner's counsel. She submits that the victim lady is ready and willing to marry the petitioner unconditionally. 6. In the first information dated 12.06.2026 submitted by the victim lady, she has stated that she got acquainted to the petitioner who was staying in the house adjacent to the house in which she was staying. Subsequently, petitioner developed friendship with the victim lady and when she confronted the petitioner with his earlier relationship with another lady, he had - 4 - HC-KAR CNR: KAHC010505682026 NC: 2026:KHC:50396 CRL.P No. 11059 of 2026 represented to her that she was only a friend. The victim lady had therefore agreed for the proposal made by the petitioner and he allegedly promised to marry the victim lady. She has alleged that as a result of their relationship, she had conceived and had suffered miscarriage. Since the petitioner had tried to maintain distance from the victim lady thereafter, she had approached the police in the month of February 2026. Petitioner who had appeared before the police, had agreed to marry her and also had stated that their marriage would be registered. Therefore, the victim lady had withdrawn her complaint. Thereafter, petitioner allegedly had gone back from his promise and it is under these circumstances, she had approached the police once again in the month of June 2026. 7. When the matter was taken up by this Court on 27.08.2026, learned Counsel for the petitioner had made a submission that petitioner is ready and willing to marry the victim lady and pendency of the case has been causing hindrance for making arrangements for their marriage. It is under these circumstances, he was granted interim bail by this Court on 27.08.2026. It is submitted by the learned HCGP and - 5 - HC-KAR CNR: KAHC010505682026 NC: 2026:KHC:50396 CRL.P No. 11059 of 2026 the learned Counsel for respondent no.2 that petitioner has not joined investigation after the interim bail was granted and he also has not approached the victim lady for the purpose of making necessary arrangement for their marriage as undertaken before this Court on 27.08.2026. Learned Counsel for respondent no.2 on instructions has made a submission before this Court that the victim lady is ready and willing to marry the petitioner unconditionally and inspite of the same, petitioner's counsel has submitted that petitioner is not willing to marry the victim lady. 8. Even on the last occasion when the first informant had approached the police in the month of February 2026, petitioner had made a similar promise to her before the police. Therefore, she had withdrawn her complaint against him. 9. The allegations found in the first information would prima facie make out a case for the alleged offences against the petitioner. The victim lady, as a result of their relationship had conceived and subsequently she has suffered miscarriage. She has produced medical documents which would go to show that - 6 - HC-KAR CNR: KAHC010505682026 NC: 2026:KHC:50396 CRL.P No. 11059 of 2026 she had suffered miscarriage, and thereafter, had undergone psychological treatment in the hospital. 10. Considering the aforesaid aspects of the matter, more so the conduct of the petitioner, I am of the opinion that petitioner is not entitled for the discretionary relief of anticipatory bail from this Court in the present case.
