On careful consideration of the impugned notice dated 27.01.2017 at Annexure-G and the endorsement dated 27.01.2017 at Annexure-H, would indicate that the respondent-Authorities have taken a decision under Section 192A of the Karnataka Land Revenue Act, 1964, without conducting spot inspection and survey in respect - 3 - HC-KAR CNR: KAHC010006292017 NC: 2026:KHC:49572 WP No. 4880 of 2017 of the land in question before issuing the impugned endorsement dated 27.01.2017 (Annexure-H). 3. In that view of the matter, I proceed to pass the following: ORDER i. The writ petition is disposed of. ii. The notice dated 27.01.2017 (Annexure-G) and the endorsement dated 27.01.2017 (Annexure-H) issued by respondent No.3 are accordingly set aside. iii. The matter is remanded to respondent No.3 to conduct spot inspection and the survey with the aid of the jurisdictional ADLR, in the presence of the petitioner and thereafter take a decision in the matter, in accordance with law. iv. In order to avoid further delay in the matter, respondent No.3 along with the jurisdictional ADLR, shall conduct spot inspection and survey in respect of the land in question on 12.10.2026 at 11.00 a.m. in the presence - 4 - HC-KAR CNR: KAHC010006292017 NC: 2026:KHC:49572 WP No. 4880 of 2017 of the petitioner and thereafter, take a decision in the matter, in accordance with law.
