Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 13 months. The evidence of the victim is in progress and there is no possibility of the trial concluding in near future. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and draws the attention of the Court to the statement of the victim recorded under Section 183 of the BNSS as well as the medico-legal examination report. I have taken into account the medico-legal examination report and on an assessment of the same, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected.
2 Learned Trial Court would expedite the process of trial and ensure that at least examination of one witness in a month be completed. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 1965 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
