JUSTICE ANANT RAMANATH HEGDE ORAL ORDER Heard the learned counsel appearing for the petitioner and the learned High Court Government Pleader for respondent No.1 and the learned counsel for respondent No.2. 2. Learned counsel the petitioner submits that the complaint is filed alleging cheating and fraud. Charge sheet is filed. Learned counsel for the petitioner would submit that the petitioner is the owner of the property and not the seller. And if at all any act committed, it is by the general power of attorney holder of the petitioner who is the brother of the petitioner and the prosecution could not have been launched against the petitioner. 3. Learned counsel respondent No.2 would submit that the layout plan which is produced by the general power of attorney of the petitioner is fake and does not bear the Digitally Signed by ANANT RAMNATH HEGDE - 3 - HC-KAR CNR: KAHC010556762026 NC: 2026:KHC:50184 CRL.P No. 12202 of 2026 signature of the authority. It is also found from the charge sheet material that the land is a Gomala land and was never the land of the petitioner and the petitioner is not the owner. 4. Under these circumstances, the Court is of the view that the questions raised by the petitioner cannot be adjudicated in this petition. The matter requires trial before adjudicating the petitioner's contention. Hence, the petition is dismissed. 5. All contentions are kept open.
