04/10.02.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Complaint Case No.18/2025, registered for the offence under Section 103(1) of the BNS, 2023, pending in the Court of the learned Sub-Divisional Judicial Magistrate, Godda.

Learned counsel appearing for the petitioner submits that the case has been registered against the petitioner, which has been investigated by the police and final form has been submitted in favour of the petitioner disclosing therein that the death has occurred due to accident and the petitioner has been exonerated and he has not been sent up for trial. He next submits that however on the protest petition, the learned Court has been pleased to take cognizance and in the cognizance order, what are the materials against the petitioner, is not disclosed.

Learned counsel appearing for the State opposed the prayer and submits that on protest petition, the learned Court has been pleased to take cognizance.

Considering that the police has investigated the matter and submitted final form and the petitioner has not been sent up for trial and this Court has perused the order dated 22.09.2025 by which the cognizance has been taken and finds that only the allegations are narrated and what are the materials and what the enquiry witnesses have stated, that is not disclosed in the cognizance order and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Godda in connection with Complaint Case No.18/2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
