Mr. Bidyut Kumar Halder, Mr. Indranil Halder, Ms. Neha Singh … for the Appellant. Mr. Debanjan Mukherjee … for the WBSEDCL.
1. None appears on behalf of the respondent No. 4.
2. The appeal has been filed challenging an order dated June 11, 2026, passed in WPA 11865 of 2026. By the order impugned the learned Court directed the WBSEDCL to grant electricity to the appellant in accordance with law, upon the appellant complying with the contents of the letter dated May 5, 2026 issued by the WBSEDCL.
3. We find from the letter dated May 5, 2026 that certain documents of identity as also a document with regard to the right of the appellant to enjoy electricity at the premises in question either as a owner or as a tenant had been asked for. We do not find any illegality in the order impugned.
4. Mr. Halder, learned advocate for the appellant submits that there is no tenancy deed and the appellant also does not have rent receipts. This issue cannot be decided by us. However, after all the documents are filed and if the appellant can prove settled possession in respect of the property in question, either as a tenant or as an occupier, in that event, the WBSEDCL will grant the connection in
2 accordance with law. We just clarify the order of His Lordship, but we do not find any particular reason to interfere with the same. The order impugned and the directions to submit all relevant documents remain unaltered.
5. Accordingly, the appeal and the connected application are disposed of.
6. Parties are directed to act on the basis of the server copy of this order.
