In Re : Md. Safi
... Petitioner.
Mr. Soumyadip Maity
... For the Petitioner.
Dr. Pradip Banerjee, APP, Ms. Shalu Gupta
... For the State.
Learned advocate appearing for the petitioner submits that petitioner has been arrested on the basis of statement of co-accused and there has been no recovery from the present petitioner. Additionally, it has been submitted that the accused persons from whom recovery has been made have already been granted bail by the learned Special Court. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail, but is unable to refute the submissions of the petitioner that the other accused persons from whom recovery has been made have been granted bail by an order dated 12.08.2026. Having considered the same, I am inclined to release the present petitioner on bail. As such, the prayer for bail of the petitioner is allowed.
2 Accordingly, the petitioner viz., Md. Safi shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, 1st Court, Purba Medinipur at Tamluk. If on bail, the petitioner shall be physically present on each and every date before the learned Special Court and shall not leave the jurisdiction of the district of Purba Medinipur without prior permission of the learned Special Court. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1940 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
