15.09.2026 IN THE HIGH COURT AT CALCUTTA Item No.M/L.185 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. C.R.M. (A) 2712 of 2026 In Re : An Application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Malipanchghora Police Station Case No. 0812 of 2026 dated 02.07.2026 under Sections 115(2)/126(2)/3(5)/351(2)/74 of the Bharatiya Nyaya Sanhita, 2023. And In Re : Satyendra Singh and another ... Petitioners. Mr. Nirmalendu Bera, Ms. Tanima Nandy ... For the Petitioners. Mr. Uttam Kumar Mandal, Mr. Arijit Banik ... For the State. Learned advocate appearing for the State has submitted Memo of Evidence which reflects that Section 3(1)(r) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 has been added and the investigation is being done by a superior officer of police. Having considered the same, I am of the opinion that the provisions of anticipatory bail are not attracted in the present case. Petitioners will exhaust their remedies in other forum. Memo of Evidence submitted by the learned advocate for the State be kept with the record. The application for anticipatory bail, being CRM (A) 2712 of 2026, is, thus, dismissed. 2 All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
