ORAL ORDER
Sri.Muralidhar H.M. counsel for the petitioner and Sri.Varun Patil, counsel on behalf of Sri.Mahammed Tahir for caveator / respondent No.1 and Smt.Spoorthi.V., HCGP for respondent No.2 appeared in person. 2. This petition is filed seeking following reliefs: (i) Allow the writ petition, issue a writ in the nature of certiorari quashing the order passed by the Karnataka Appellate Tribunal, Bengaluru, in Appeal No.217/2023 dated 25.07.2025 vide Annexure-A and also the award dated 20.06.2023 passed by the 2nd respondent in Dispute No.JRB/MD/100/2016- 17 vide Annexure-B. (ii) In the alternative, pass such other order/s as this Hon'ble Court deem fit to pass on the facts

and in the circumstances of the case, in the interest of justice and equity. 3. Sri.Varun Patil, counsel for caveator / respondent No.1 submits that the first respondent has shown to a declaration of fact in the form of an affidavit and the same may be taken on record and the petition may be disposed of.
The affidavit reads as under:
"I Smt. Meenakshi Roy, W/o Prashanth Roy, Aged about 62 years, R/at No.17, 'B' Block, C.I.L Layout, 3rd main Road, Sanjayanagar, RMV II Stage, Bengaluru- 560094, do hereby solemnly affirm and state on oath as follows;
1. I am the Respondent No.1 in the above case, I know the facts of the case and hence, I am swearing to this affidavit. 2. I state that, the Petitioner Society has executed an absolute sale deed dated 09-09-2026 in respect of Site No. 387 with BDA E-Khata No. 6000091206 at Rajiv Gandhinagar, NTI Layout, 3rd Phase, Bengaluru-560092 measuring 40x50ft =2000 sq.ft. - 4 -

3. I state that, I am ready and willing to register the absolute sale deed in my favour in respect of the aforementioned site at the earliest. 4. I state that, the Petitioner Society has requested me to pay Rs.16,00,000 (16 Lakhs) towards final charges. I further state that, I am ready and willing to deposit the afore mentioned amount with the Petitioner society within a period of 3 weeks from the date of registration of the sale deed. I, the Deponent, above-named, state that this is my name and signature and the contents of this Affidavit, stated in the foregoing paragraphs are true and correct to the best of my knowledge, information and belief."
4. In view of the affidavit filed by the respondent No.1, the writ petition is disposed of. On disposal of the Writ Petition, any interim order stands discharged, and any pending interlocutory applications, if any, are disposed of. Sd/- (JYOTI M) JUDGE
