JUSTICE T.P.VIVEKANANDA) This contempt petition is filed complaining wilful disobedience of the Order dated 24.08.2022 passed by the learned Single Judge in WP No.14245/2022. 2. The said writ petition was filed seeking direction to the revenue authorities to consider the representation dated 17.02.2022 for Phodi and Durasthi of Sy.No.656/2A2 of Kanakapura Village and demarcate the land belonging to the petitioner to an extent of 18.04 guntas out of the larger extent in the aforesaid survey number. The direction in the writ petition was to conduct Phodi after issuing notice to the concerned and in terms of the earlier direction issued by respondent No.3 - Deputy Director of Land Records. 3. The accused has filed compliance affidavit dated 24.08.2023 contending that the entire land in question has been developed and portion of the land was converted and therefore, Phodi and Durasti cannot be carried out. In that light, an endorsement dated 26.06.2023 was issued to the writ petitioner/complainant. Simultaneous with the issuance of the endorsement, the revenue authorities, i.e., the State has also filed WA No.1001/2023. The said writ appeal is pending consideration. 4. In the light of the fact that the order passed in the writ petition willful disobedience of which is complained of, is under challenge in WA No.1001/2023 and the State has also issued the endorsement dated 26.06.2023, informing the - 4 - HC-KAR CNR: KAHC010220732023 NC: 2026:KHC:50398-DB CCC No. 436 of 2023 complainant that the portion of the land in question is already converted and Layout Plan has been approved, we do not propose to continue this contempt proceedings. We are of the opinion that there is no willful disobedience of the directions issued by the learned Single Judge. Accordingly, the Contempt of Court case is dropped. 5. It is needless to observe that if the complainants are aggrieved by the endorsement dated 26.06.2023, it is open for them to challenge the same in accordance with law.
