C528 No.270 of 2026 Hon ’ble Alok Mah r a, J.
Mr. Vaibhav Singh Chauhan, Advocate for the applicant.
2. The applicant claims to have filed an application under Section 126(2) of the Code of Criminal Procedure, 1973 read with Section 145(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 against the respondents.
3. By the present criminal miscellaneous application, the applicant seeks a direction to the learned trial Court to expedite the disposal of the aforesaid application.
4.
Learned counsel for the applicant submits that notice of the said application was duly served upon the respondents. Respondent no.1 entered appearance before the Court of the learned Principal Judge, Family Court, Haridwar on 27.06.2025 and sought time to file objections. Despite the matter being listed on several subsequent dates, perusal of the order sheet reveals that no objections have been filed by the respondents to date.
5. Examination of the order sheet indicates that more than eight months have elapsed without any objections being filed by the respondents. This delay appears to be a deliberate tactic to protract the proceedings.
6. In view of the foregoing, the
2026:UHC:1196 criminal miscellaneous application is allowed. The Court concerned is directed to decide the aforesaid application expeditiously, preferably within a period of three months’ from the date of production of a certified copy of this
order.
