The petitioner has filed this petition seeking the following relief(s):- “10.1 That, this Hon'ble Court may kindly be pleased to call entire records from the respondents. 10.2 That, the Hon'ble Court may kindly be pleased to grant any other relief, as it may deems fit and appropriate. Digitally signed by NADIM MOHLE 2 10.3 That, the Hon'ble Court may kindly be please to set aside the impugned date of paragraph 03 issued by respondent no. 2 dated 03.02.2022 (Annexure P/1) and further be pleased to direct the respondent no. 2 to issue the order of petitioner for compassionate appointment in place of his deceased father Late Hiralal Gond. 10.4 That, the Hon'ble Court may kindly direct the respondent to appointed petitioner in the place of his deceased father Hiralal Gond as compassionate ground. 10.5 That, the Hon'ble Court may kindly direct the respondent to avail all benefit on behalf of deceased employee Hiralal Gond to the petitioner as considering the status of as regular employee of Hiralal Gond and his seniority be considered accordingly as per law.” 2. It is pleaded that father of the petitioner namely Hiralal Gond was working as Permanent Labour (Gang) under the Public Works Department, Sub Division Pendra, since 01.03.1986, who died in harness on 07.10.2007. The petitioner herein moved an application for grant of compassionate appointment on 07.12.2020 and respondent No.2/Executive Engineer rejected the said application vide order dated 03.02.2022 (Annexure P/1) on the ground that father of the petitioner was not a regular employee under the workcharge establishment. 3. According to clause 2 of the order, page number 2987/2571/06/19/Stha-4/Raipur, dated 27.04.2006 of the Chhattisgarh Government, Public Works Department, Ministry, Dau Kalyan Singh Bhawan, Raipur, Gangmen who have not been regularized in their workcharge establishment are not eligible for compassionate appointment. 3 4. Since father of the petitioner was laborer, therefore, the petitioner/Kushal Singh Gond, is not entitled for compassionate appointment. 5.
