JUSTICE MOHAMMAD NAWAZ ORAL JUDGMENT This appeal is preferred against the order of the learned Sessions Judge, rejecting the application filed under Section 482 of the BNSS. 2. Appellant is accused No.6 in the charge sheet filed by the KTJ Nagar Police Station in connection with Crime No.249/2017, for the offences punishable under Section 420 read with Section 34 of IPC and Section 9 of the KPIDFE Act, 2004. 3. As per charge sheet allegations, the accused have collected money from the public, assuring them of higher rate of interest and later cheated them to the tune - 3 - HC-KAR CNR: KAHC010256332026 NC: 2026:KHC:50217 CRL.A No. 668 of 2026 of Rs.82,32,949/- between the period 2009 to 2014. The said money is alleged to have been utilized for establishing some other companies like Maithri Insurance Service Pvt.Ltd., Maithri Realter India Pvt. Ltd., Sri Nakshatra Builders and Developers India Pvt. Ltd., Sri. Nakshatra Global Soft Pvt. Ltd., Sri Nakshatra Granites Pvt. Ltd., in the States of Karnataka, Andra Pradesh, Telangana and Kerala. 4. Considering the facts and circumstances and materials on record, the learned Sessions Judge has dismissed the prayer seeking anticipatory bail. 5. The appellant, arraigned as accused No.6 is said to be a Director and incharge of the offices in Karnataka region. According to the prosecution, with the sole intention to cheat the public, the Branch office was opened in Davanagere and money was collected from the public promising more rate of interest and the said amount was diverted for the benefits of the accused. FIR was - 4 - HC-KAR CNR: KAHC010256332026 NC: 2026:KHC:50217 CRL.A No. 668 of 2026 registered on 28.10.2017. As on today the appellant is absconding. 6. It is submitted by the learned High Court Government Pleader that NBW is issued against the appellant. 7. In the above facts and circumstances, the appellant is not entitled to the relief and there is no error committed by the learned Sessions Judge in dismissing the application. 8. If the appellant appears before the trial Court and files any application for regular bail, the same be considered expeditiously. Appeal is dismissed. I.A.No.1/2026 is dismissed.
