Learned advocate for the petitioner submits that the petitioner is in custody for nine months and presently charges have been framed, date has been fixed for commencement of witness action. Learned advocate for the defacto- complainant/private opposite party opposes the prayer for bail. Learned advocate for the State has drawn the attention of the court to the statement of the victim under section 183 of the BNSS as well as the medicolegal examination report. 2 Having considered the same, I am of the view that till the examination of the victim is over, it would not be fit and property to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. However, the learned trial court would, if it is possible, prepone the date for evidence of the victim Accordingly, CRM(M) 2707 of 2025 is dismissed.
