1. By way of filing the instant petition, a challenge has been made to the impugned FIR No.192/2021 registered with Police Station Ganj, District Ajmer for the offences under Sections 143, 341, 323, 504, 506 & 427 of IPC and Section 3(2)(va) of SC/ST Act.
2. The contents of the petition, as well as the grounds taken therein, state that no such incident has taken place and the petitioner has been falsely implicated in the instant case.
3. Perusal of the allegations leveled in the FIR reveals commission of cognizable offence. The correctness of such allegations cannot be examined by this Court at this stage, while exercising its inherent jurisdiction contained under Section 482
[2026:RJ-JP:10834] (2 of 2) [CRLMP-5858/2021] Cr.P.C. and certainly, this task has been assigned to the investigating agency.
4. Considering the overall facts and circumstances of the case, this Court deems it just and proper to dispose of the instant petition granting liberty to the petitioner to file an appropriate representation before the Investigating Agency. It is expected from the Investigating Officer to consider the same and in case the involvement of the petitioner is found to be proved then notice under Section 41-A Cr.P.C. be issued to the petitioner and he would be at liberty to proceed with the matter in accordance with law. With the aforesaid observations the petition stands disposed of.
5. Accordingly, the instant petition stands disposed of.
6. All pending applications as well as the stay application also stands disposed of.
7. In case after investigation, charge-sheet has already been submitted in the instant matter then the petitioner would be at liberty to take all available defenses and grounds taken before this Court, at the appropriate stage of the trial.
