Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 4 months and out of 33 witnesses, only 3 witnesses have been examined, as such, petitioner may be released on bail. Learned advocate for the petitioner also submits that the prosecution has failed to establish any case while submitting the charge-sheet so far as the offence under Section 103 of the BNS, 2023 is concerned. Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the statement of eyewitnesses. There are number of eyewitnesses in the present case whose statements have been recorded under Section 183 of the BNS, 2023. The same includes the friends as well as the relatives of the deceased. 2 Learned trial court would give priority to examination of those witnesses whose statements have been recorded under Section 183 of the BNS, 2023. Petitioner would renew the prayer for bail after the evidence of such witnesses are over. At this stage, I am not inclined to release the petitioner on bail. Accordingly, CRM(M) 433 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
