ORAL ORDER
Seeking for transfer of proceedings in MC no.15/2025 on file of Senior Civil Judge and JMFC, Sidlaghatta to Senior Civil Judge and JMFC, Bangarpet, this petition is filed.
2. Sri Anand B.N., learned counsel for petitioner submitted that marriage of petitioner and respondent was solemnized on 17.05.2023 at Bangarpet and from wedlock, a child was born. Subsequent martial discord constrained petitioner to move to her maternal home at Bangarpet. In meanwhile, respondent filed divorce petition before Senior Civil Judge and JMFC, Sidlaghatta. It was stated that petitioner was facing difficulty to travel from Bangarpet to Sidlaghatta with a child. Apart from above, she had filed petition under Protection

of Women from Domestic Violence Act, 2005 ('DV Act') which was pending at Bangarpet. Therefore, for consolidation of proceedings, petition was required to be transferred. On said grounds sought for allowing petition.
3. Smt.N. Roopa, learned counsel appearing for Sri N. Sridhar, advocate for respondent however would oppose petition. It was submitted, distance between these two places was not substantial and there would be no inconvenience.
4. Heard learned counsel and perused petition.
5. This petition is for transfer of proceedings in MC no.15/2025 on file of Senior Civil Judge and JMFC, Sidlaghatta to Senior Civil Judge and JMFC, Bangarpet.
6. Hon'ble Supreme Court in cases of Sumita Singh v. Kumar Sanjay & Anr., reported in (2001) 10 SCC 41; Rajani Kishor Pradeshi v. Kishor Babulal Pardeshi, reported in (2005) 12 SCC 237 and NCV Aishwarya v. AS Saravana Karthik Sha, reported in (2022) SCC OnLine SC 1199, has held that while considering petition for transfer of

matrimonial proceedings, convenience of wife would be of paramount consideration. In instant case, petitioner has filed proceedings under DV Act at Bangarpet and respondent would require to attend same at Bangarpet in any case. Therefore for consolidation of proceedings at one place, besides convenience of wife, petition would require consideration.
7. Hence, petition is allowed, proceedings in MC no.15/2025 pending before Senior Civil Judge and JMFC, Sidlaghatta stands withdrawn and transferred to Senior Civil Judge and JMFC, Bangarpet.
Transferee Court is directed to expedite proceedings.
