In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Hogolberia Police Station case no. 58 of 2022 dated 21.02.2022 under Sections 376D of the Indian Penal Code and Section 6 of the POCSO Act,

And In the matter of : Bikram Sardar @ Mal
……Petitioner. Mr. Santanu Talukdar Mr. Amanul Islam Mr. Sourav Mukherjee Mr. Gourav Roy
.....for the Petitioner. Mr. Sayak Chakrabarti Ms. Supriti Sarkhel
……for the State.
Petitioner has approached this Court for renewal of prayer for bail because of long period of incarceration. It has been pointed out that the examination-in-chief of the victim has been concluded but the cross-examination is yet to be concluded. As such there is no new change in circumstances since the earlier rejection of bail. Petitioner would approach this Court immediately after the cross-examination of the victim is over. Learned trial Court would ensure that at regular intervals dates are fixed for evidence of the victim.
2 With the aforesaid observations, CRM (M) 1992 of 2026 is dismissed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
