CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 23.04.2026
03. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Dasarathpur P.S. Case No.10 of 2026 corresponding to C.T. Case No.82 of 2026 pending in the court of learned S.D.J.M., Jajpur on the grounds stated. 3. Perused the FIR as at Annexure-1. This Court by order dated 26th March, 2026 had directed the State to submit the injury report of the victim, which is complied with and produced today and on reading of the same, it is revealed that the injured, namely, Sulekha Jena received a laceration, blunt trauma and abrasion on her head but stated to be simple in nature with an opinion therein that it might have been caused to a blunt and hard object. It is submitted to the Court by Mr. Panda, learned counsel that the petitioners are related as father and son and do not have any antecedent and happen to be the neighbour of the informant. It is claimed that on account of
civil dispute between the parties, the alleged incident has taken place. Recording the objection of the State and considering the case diaries and statements of the witnesses recorded under Section 180 BNSS during investigation and the circumstances under which the alleged incident took place and described by them and also the medical examination report of the above named victim without any grievous injury, this Court is inclined to direct both of them to surrender before the learned court below to go on bail with stringent conditions instead of entertaining their plea for pre-arrest bail. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL petition stands disposed of with a direction to the petitioners to surrender before learned S.D.J.M., Jajpur within a fortnight from today and in the event, they surrender in compliance thereof, shall be released on bail in connection with C.T. Case No.82 of 2026 on furnishing a bail bond of Rs.30,000/- (rupees thirty thousand) each with one solvent surety for the like amount each to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. 6. Issue urgent certified copy of this order as per rules.
