PUBLIC PROSECUTOR THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 4694 of 2026 Order: This is a second bail application filed by petitioner/A52 under Sections 480 and 483 of the B.N.S.S., seeking regular bail in connection with Crime No.21 of 2024 of C.I.D. Police Station, Mangalagiri, Guntur District, registered for the offences punishable under Sections 409, 420 and 120-B read with Sections 34, 37 of the Indian Penal Code, 1860 and Sections 7, 7(a), 8, 13 (1) (b) & 13(2) of the Prevention of Corruption Act, 1988. 2. Case of the prosecution, in brief is that the petitioner was shown as Accused No.52 in the liquor scam by a syndicate of high level state Government officials, private persons and political executives that generated more than 3,500 crores from the year 2019 to 2024 , which caused huge loss to the State Exchequer. The petitioner/A52 was arrested on 02.03.2026 and produced before the Court on 05.03.2026 and remanded to judicial custody from thereon. 3. Heard Sri S.Nageswara Reddy, learned counsel for the petitioner/A52 and Sri B.Adinarayana, learned Senior Counsel assisted by Sri Palaparthi Sathvik, learned Assistant Public Prosecutor appearing on behalf of State. 4. Learned counsel for the petitioner/A52 submits that earlier bail application filed by the petitioner was dismissed by this Court in Crl.P.No.3321 of 2026, by order dated 06.05.2026, on the grounds of nature of the role attributed by the petitioner and the stage of investigation. He further submits that the petitioner/A52 has been in judicial custody for the past 120 days and further requests this Court that the petitioner/A52 may be enlarged on bail. 5. Sri B.Adinarayana, learned Senior Counsel on behalf of the State would submit that, the investigation is completed and police report has also been filed before the trial Court on 28.05.2026. He further submits that, while considering the bail application of the petitioner/A52 some stringent conditions may be imposed. 6. Considering the submissions made by the learned counsel for the petitioner as well learned Senior Counsel appearing on behalf of State, and upon perusal of the material on record, this Court is of the view that since the investigation has been completed, police report had also been filed on 28.05.2026, and in the light of change of circumstances, this Court is inclined to enlarge the Petitioner on bail, subject to the following conditions: i) The petitioner/A52 shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for a like sum each, to the satisfaction of the Special Judge for SPE & ACB Cases, Vijayawada. ii) Since it is represented that the passport of the petitioner has already been surrendered before the trial Court, the petitioner shall not leave India without prior permission of the trial Court. iii) The Petitioner/A52 shall not leave the limits of the State without giving intimation to the Investigating Officer. The Investigating Agency shall furnish their Whatsapp mobile number to the Petitioner/A52 for the purpose of convenience. iv) The Petitioner/A52 shall appear before the Investigating Officer as and when required and shall cooperate with further investigation, if any. v) The Petitioner/A52 shall not directly or indirectly tamper with evidence nor influence, intimidate, or induce any prosecution witness. vi) The Petitioner/A52 shall not contact any of the prosecution witnesses or co-accused, except during legal proceedings. vii) The Petitioner/A52 shall file his affidavit before the trial Court disclosing all his movable and immovable properties, bank accounts, demat accounts, business interests and financial holdings, whether held individually or jointly within a period of two weeks from the date of his release. viii) The Petitioner/A52 shall not make or publish or disseminate any information, statement, or post whether in print, electronic or social media concerning the present crime till conclusion of the trial. ix) The Petitioner/A52 shall not alienate, encumber, or create third- party interests in any property disclosed by them or identified by the prosecution, without prior permission of the trial Court. x) The Petitioner/A52 shall furnish his active mobile number to the Investigating Officer and shall be available at all times and any change shall be intimated forthwith. xi) The Petitioner/A52 shall appear before the Investigating Agency once in a week i.e., on every Saturday between 10:00 am and 05:00 pm until further orders. In the event of violation of any of the above conditions, the prosecution is at liberty to seek cancellation of bail.
