Mr. Dattatreya Dutta …for the petitioner Leave to amend the name of one of the accused, namely, Subhas Halder is granted. In this application, the petitioner is aggrieved with the delay in disposal of his application filed under Section 193(9) of the BNSS. Learned Counsel appearing on behalf of the petitioner submits that he filed the said application, i.e. protest petition against the investigation done by the Investigating Agency on 10th June, 2026. Learned Court below fixed the next date for hearing of the said petition 1½ years thereafter, i.e. on 20th November, 2027. Therefore, the petitioner has prayed for preponing the date and to make further direction for expeditious disposal of the said prayer. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice and as such service of copy of application upon the opposite party is dispensed with. Having considered submissions made on behalf of the petitioner that the next date has been fixed for hearing 1½ year from the date of filing of the application, I find that the prayer 2 made by the petitioner is justified and is required to be allowed to secure the ends of justice. In view of above, the instant application being CRR 3664 of 2026 is hereby disposed of with a direction upon the Court below to prepone the next date of hearing of the said application filed under Section 193(9) of BNSS by the petitioner to the month of December, 2026 after serving notice upon the concerned opposite party and to make his best endeavour to dispose of the said application on the preponed date or preferably within a period of 30 days thereafter.
