Learned advocate appearing for the petitioner submits that the prosecution case relates to alleged recovery of 23.9 kgs of ganja from the joint possession of the petitioner and others. Charge-sheet has already been submitted and the petitioner is unnecessarily languishing in jail for about seven months. Learned advocate appearing for the State opposes the prayer for bail. Having regard to the quantum of seizure in the instant case, I am of the opinion that rigors of Section 37 of the NDPS Act is attracted. As such, prayer for bail of the petitioner is rejected. Petitioner will renew his prayer for bail after the evidence of independent witnesses are over. Accordingly, CRM (NDPS) 1695 of 2026 is dismissed.
2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
