JUSTICE S.G.PANDIT) In this batch of writ petitions, identical orders passed by the Karnataka State Administrative Tribunal at Bengaluru (for short “Tribunal”) in Application No.4589/2022 dated 30.03.2023 (impugned in W.P.No.35267/2024); Application No.714/2020 dated 01.12.2021 (impugned in W.P.No.34039/2024); Application No.1125/2020 dated 28.06.2021 (impugned in W.P.No.34171/2024); and Application No.4717/2021 dated 06.06.2022 (impugned in W.P.No.34657/2024) are under challenge by the State Authorities in Revenue Department. The order portion in one of the Applications, i.e. Application No.4589/2022 dated 30.03.2023 reads as under: “(i) The application is hereby allowed; (ii) The respondents are hereby directed to consider the case of the applicant in the light of the recommendation of the 2nd respondent to the 1st respondent to accord retrospective - 6 - HC-KAR NC: 2026:KHC:21966-DB WP No. 35267 of 2024 C/W WP No. 34039 of 2024 WP No. 34171 of 2024 AND 1 OTHER promotion to the applicant in terms of recommendation letter bearing No.Sibbandi (1)/CR-135/2017-18 dated 28.05.2018 and extend the benefits as granted to Sri Lokesh Kumar, Sri.R.G.Nagabhushan, Sri.Nataraj, Sri.Srinivas, Sri.Shivanand Reddy Sidda & Sri.B.M.Manjunath, who are the applicants in A.1125/2020, A.752/2020, A.751/2020, A.686/2020, A.753/2020 and A.688/2020 respectively. (iii) The time for compliance is two months from the date of receipt of copy of this order.” 2. Identical directions are issued in all other applications by the Tribunal. This Court had an occasion to consider identical directions issued by the Tribunal in W.P.No.23028/2024 and connected writ petitions decided on 18.09.2025 (The Principal Secretary to Government and another V/S Sri.C.Nagesh). The said batch of writ petitions was disposed of by this Court by order dated 18.09.2025. Learned counsel appearing for the parties would not dispute the fact that decision rendered in W.P.No.23028/2024 dated 18.09.2025 would squarely apply to the facts of the present case. In the above circumstances, the following: ORDER The writ petitions stand disposed of. The orders in Application No.4589/2022 dated 30.03.2023 (impugned in W.P.No.35267/2024); Application No.714/2020 dated 01.12.2021 (impugned in W.P.No.34039/2024); Application No.1125/2020 dated 28.06.2021 (impugned in W.P.No.34171/2024); and Application No.4717/2021 dated 06.06.2022 (impugned in W.P.No.34657/2024) passed by the Tribunal are modified. Consequently, the petitioners are directed to consider the cases of the respondents for retrospective promotion from the date - 9 - HC-KAR NC: 2026:KHC:21966-DB WP No. 35267 of 2024 C/W WP No. 34039 of 2024 WP No. 34171 of 2024 AND 1 OTHER they were placed in independent charge under Rule 32 of KCSRs and pass appropriate orders, in accordance with law.
