The petitioner is apprehending his arrest in connection with Manatu P.S. Case No. 72 of 2025, registered for the offence under Sections 126(2), 115(2), 117(2), 109, 352 and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Palamau at Daltonganj. 3. Learned counsel appearing for the petitioner submits that the altercation took place due to drainage of water in front of the house of the informant. He next submits that the petitioner was having no role in spreading water in front of the house of the informant, in spite of that the informant has entered into the altercation. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegation of assault is there. 5. Considering that the said altercation took place only with regard to drainage of water in front of the house of the informant, however, in the order of the learned Sessions Judge, it has come that the injury report has not been collected so far, in that view of the [2026:JHHC:8525] -2- matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
