For quashing of memo no. 351 dated 19.02.2020 (Annexure-5) whereby and where under the claim for grant of 3rd Modified Assured Career Progression to the petitioner has been rejected on the ground that the petitioner has not passed the departmental examination, without taking into consideration the fact that the Secretary, Government of Jharkhand vide memo no.2380 dated 22.09.2008 has already taken a decision that since no departmental examination could be taken after the division of the State the Principles/Teachers working in Senior Scales and Clerks working in the Government Schools were exempted from 2026:JHHC:2045 2 passing the departmental examination for grant of increments and other promotional benefits and in spite of the decision taken by the state government, the respondent authorities has rejected the claim of the petitioner which is not tenable in the eyes of law. ii. Further issuance of a direction upon respondents commanding upon them to grant benefits of 3rd Modified Assured Career Progression Scheme (hereinafter referred as M.A.C.P.) as the petitioner has already completed 30 years of their services and they have been granted benefits of 1st A.C.P. and the 2nd A.C.P. and they are otherwise also eligible for getting benefits of 3rd M.A.C.P. as per the circular of Government of Jharkhand and further to recalculate and pay entire retiral dues after granting benefits of 3rd M.A.C.P. with arrears and appropriate cost.” 2. Heard learned counsel representing the petitioner and learned counsel representing the respondents. 3. Learned counsel representing the respondents submits that the entire payment has been made. He produces a copy of the e- payment receipt in support of his submission. A copy of the same has also been handed over to learned counsel representing the petitioner. 4. A copy of the aforesaid e-payment receipt is hereby kept on record. 5. Considering the aforesaid submission, this writ petition stands disposed of.
