Heard learned counsel for the petitioners as well as learned A.P.P. 3. It is submitted by learned counsel for the petitioners that the petitioners has instituted a Complaint Case No. 1896 of 2023 which is pending before the Court of Judicial Magistrate, First Class, XXVII, Ranchi. The husband of the petitioner also filed a case under Section 9 of the Hindu Marriage Act, 1955, for restitution of conjugal rights before 2026:JHHC:2354 2 the learned Principal Judge, Family Court, Ranchi. Subsequently, the present F.I.R. Daltonganj Town P.S. Case No. 193 of 2023 (Annexure-3) was instituted against the petitioner and her entire family members as a matter of retaliation. The informant of the case is also Class-III employee. The husband of the petitioner happens to be employee of Civil Court, Palamau, hence he has lodged a false case against the entire family members of the petitioner. Thereafter, he also instituted Original Suit No. 269 of 2024 under Section 13(1)(ia) of Hindu Marriage Act before the Family Court, Ranchi. Since, the opposite party No.2 is an employee of the Civil Court, Palamau and the case is also pending there, therefore, the petitioner has a reasonable apprehension that a fair trial may not be conducted. Moreover, the petitioner is facing economic crisis due to non-payment of any maintenance allowance by opposite party No.2. It is quite difficult for the petitioner to attend the Court at Palamau on each and every date to face the trial. 4. On the other hand, the petitioner herself is prosecuting a divorce case in the Civil Court, Ranchi itself therefore, it would not be convenient for her to attend the Court and prosecute the aforesaid case in Palamau (Daltonganj). Hence, petitioner prayed for transfer of Daltonganj Town P.S. Case No. 193 of 2023, pending in the Court of learned Chief Judicial Magistrate, Palamau (Daltonganj) to the Court of a competent Judicial Magistrate, Ranchi. 5. Having considered the aforesaid facts and circumstances, the convenience as well as apprehension of the petitioner and also in view of fair trial of the case, I feel inclined, in the ends of justice, to allow the prayer made by the petitioners. 2026:JHHC:2354 3 6. Accordingly, Daltonganj Town P.S. Case No. 193 of 2023, which is pending before the Court of learned Chief Judicial Magistrate, Palamau (Daltonganj), is hereby transferred to the Court of learned Chief Judicial Magistrate, Ranchi. 7.
