learned counsel appearing on behalf of Mr. N. K. Das, learned counsel for the respondent No.2, i.e., Hirendra Deka. Ms. Hussain, learned counsel for the respondent No.2 has submitted that the applicant has already paid the cheque amount of Rs.7,00,000/- to him and, therefore, he has no
Page No.# 2/2 grievance against the applicant now. I have considered the submissions made by learned counsel for both the sides. Since, both sides have compromised the matter and the respondent No.2 has received back the money, this Court is of the opinion that there is nothing left to be decided. Therefore, the Judgment dated 30.04.2024, passed by the learned Additional Chief Judicial Magistrate, Darrang, Mangaldai in the NIR Case No.15/2022 is set aside. Accordingly, the Appellate Judgment dated 14.07.2025, passed by the learned Additional Sessions Judge (FTC), Darrang, Mangaldai in Criminal Appeal No.17/2024 is also set aside. The connected Criminal Revision Petition is disposed of Accordingly. Therefore, the applicant Kamal Lochan Bora shall be set at liberty forthwith.
