The Criminal Petition has been filed under Section 439(1)(b) of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.,’)/Section 483(1)(b) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to modify the condition imposed on the petitioner/Accused Nos.1 and 2 vide order dated 18.05.2026 in Crl.M.P.No.553 of 2026 in Crime No.46 of 2026 of Ichapuram Police Station, passed by the learned Special Judge for Trial of Cases under N.D.P.S. Act-cum-I Additional District & Sessions Judge, Srikakulam. 2.
2. The learned counsel for the petitioners submits that the financial condition of the petitioners is deplorable and he is unable to comply with the conditions imposed by the learned Trial Court. 3. Heard learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. 4. Considering the above facts and circumstances of the case, the order dated 18.05.2026 in Crl.M.P.No.553 of 2026 in Crime No.46 of 2026 of Ichapuram Police Station, passed by the learned Special Judge for Trial of Cases under N.D.P.S. Act-cum-I Additional District & Sessions Judge,
Srikakulam, against the petitioners/Accused Nos.1 and 2 is hereby modified as under: i. The Petitioners/Accused Nos.1 and 2 shall be enlarged on bail subject to their executing a bond for a sum of Rs.15,000/- (Rupees Fifteen thousand only) with two sureties for the like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Ichapuram. 5. The residual conditions imposed by the learned Trial Court, in the original order shall remain in force and shall be duly complied with by the Petitioner/Accused Nos.1 and 2. 6.
