This writ petition assails action of the respondent Bank under the relevant provision of the Securitisation and Reconstruction of Financial Assets & Enforcement of Security Interest Act, 2002. 3. The petitioner contends that the Bank has been issuing notices for sale of the petitioner’s residential property. 4. The Bank submits that the petitioner has already approached Debts Recovery Tribunal No.3, Kolkata (DRT-III) by filing an application under Section 17 of the 2002 Act which has been registered as TSA 4 of 2026. A copy of an order dated August 25, 2026 passed by DRT- III, Kolkata has been handed up to Court which indicates that the TSA 4 of 2026 has been fixed for final hearing on December, 16, 2026. 5. Since, the relevant Debts Recovery Tribunal has already fixed the petitioner’s SARFAESI Application for 2 hearing on December 16, 2026, this writ petition is disposed of by requesting the Debts Recovery Tribunal- 3, Kolkata to dispose of the TSA 4 of 2026 along with all interlocutory applications as expeditiously as possible and preferably within a month from the next date fixed, without granting any unnecessary adjustment to either of the parties. 6.
